1. Who we are and how to reach us
Winnow is operated by Michelle Walstra, an individual developer based in Calgary, Alberta, Canada. For any questions about these Terms, contact us at info@getwinnow.app.
2. Acceptance of these Terms
By downloading, installing, or using the Winnow app, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these Terms, do not use Winnow.
These Terms form a binding agreement between you and Michelle Walstra (operating as Winnow). If you are using Winnow on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. What Winnow is — and is not
Winnow is a personal conversation analysis tool. It records or accepts audio and text transcripts of conversations, processes them using AI, and returns observations about communication patterns, conversational dynamics, and personal growth opportunities.
Winnow is not:
- A medical device
- A mental health service
- A substitute for professional therapy, counselling, coaching, or any other clinical or licensed service
- A diagnostic tool of any kind
The analysis and observations Winnow generates are produced by an AI model and are intended for personal reflection only. They are not professional advice — legal, medical, psychological, or otherwise. Winnow makes no representations about the accuracy, completeness, or suitability of its analysis for any particular purpose.
If you are experiencing a mental health crisis or require professional support, please contact a qualified mental health professional or an appropriate crisis service in your region.
4. Eligibility
You must be at least 17 years old to use Winnow. By using Winnow, you represent that you are at least 17 years of age. If we become aware that a user is under 17, we will terminate their account and delete their data.
5. Account
You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at info@getwinnow.app if you believe your account has been compromised.
6. Subscription and billing
Free trial
New accounts receive a 7-day free trial. No charge is made during the trial period.
Subscription price
After the trial, Winnow is available by subscription at USD $14.99 per month.
Billing
All billing is handled by Apple through the App Store. By starting a subscription, you authorise Apple to charge the applicable fee to your Apple ID payment method on a recurring monthly basis.
Auto-renewal
Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the renewal date.
How to cancel
To cancel your subscription, go to: iPhone Settings → Apple ID → Subscriptions → Winnow → Cancel Subscription. Cancellation takes effect at the end of the current billing period. You retain access to Winnow until that date.
Refunds
We do not offer refunds for partial billing periods. All refund requests for App Store purchases are subject to Apple's refund policy and must be directed to Apple.
Price changes
We reserve the right to change the subscription price. We will give you reasonable advance notice of any price change. Continued use of Winnow after a price change takes effect constitutes your acceptance of the new price.
7. Your content
Ownership
You retain full ownership of the conversations, transcripts, and reports you create in Winnow. Nothing in these Terms transfers any intellectual property rights from you to us.
Licence to process
By submitting audio or transcript content to Winnow, you grant Michelle Walstra a limited, non-exclusive, royalty-free licence to process that content solely for the purpose of providing you with the Winnow service — specifically, transcription, AI analysis, and report generation. This licence is temporary: audio files are deleted immediately after processing. Transcripts and reports are retained only as long as your account exists.
No other use
We do not use your conversation content for advertising, to train AI models, or for any purpose other than providing you with your report.
8. Recording consent and your responsibilities
Recording laws vary by jurisdiction. In some places, all parties to a conversation must consent before it may be recorded. In others, only one party's consent is required.
You are solely responsible for understanding and complying with the recording consent laws that apply in your location and the location of any other participants. Winnow does not monitor or enforce compliance with these laws.
By uploading or recording a conversation in Winnow, you represent that you have obtained all necessary consents required by applicable law to record and process that conversation.
You also represent that you have appropriate authority or consent to submit any text transcript you paste into Winnow.
9. Acceptable use
You agree not to use Winnow to:
- Record or process conversations without obtaining legally required consent from all participants
- Upload content that is unlawful, defamatory, harassing, threatening, or that violates the rights of any third party
- Attempt to reverse-engineer, decompile, or copy any part of the Winnow app or its underlying systems
- Access or attempt to access another user's account or data
- Use Winnow for any commercial surveillance, monitoring, or intelligence-gathering purpose
- Circumvent any security, access control, or authentication mechanism in the app
- Use automated scripts or bots to interact with Winnow
- Transmit malware, viruses, or any malicious code
10. Account termination
By you
You may delete your account at any time from the Settings screen. Deletion is permanent and immediately removes your data in accordance with our Privacy Policy.
By us
We reserve the right to suspend or terminate your account at any time, with or without notice, if:
- You breach these Terms
- We are required to do so by law
- Continued provision of the service to you creates legal or operational risk
If your account is terminated by us for a breach of these Terms, you will not be entitled to a refund for any unused portion of a subscription period.
11. Intellectual property
All rights in the Winnow app, including its design, code, branding, and interface, are owned by Michelle Walstra. Nothing in these Terms grants you any right to use the Winnow name, logo, or any other intellectual property except as necessary to use the app in the ordinary way.
12. Disclaimer of warranties
To the maximum extent permitted by applicable law, Winnow is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:
- Winnow will be uninterrupted, error-free, or available at any particular time
- The analysis or observations generated by Winnow will be accurate, complete, or suitable for any particular purpose
- Any errors or defects will be corrected
13. Limitation of liability
To the maximum extent permitted by applicable law, Michelle Walstra shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of data, revenue, profits, or goodwill
- Damages arising from decisions you make based on Winnow's analysis
- Damages resulting from unauthorised access to or alteration of your data
In any case, our total liability to you for any claim arising from your use of Winnow shall not exceed the amount you paid for Winnow in the 12 months immediately preceding the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
14. Indemnification
You agree to indemnify and hold harmless Michelle Walstra from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of Winnow; (b) your breach of these Terms; or (c) your violation of any applicable law, including recording consent laws.
15. Governing law and disputes
These Terms are governed by the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of Winnow that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of the Province of Alberta.
If you are a consumer resident in a jurisdiction with mandatory consumer protection laws, nothing in these Terms affects your rights under those laws.
16. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email before they take effect. The effective date at the top of this document indicates when these Terms were last updated. Continued use of Winnow after updated Terms take effect constitutes your acceptance of the changes.
17. Severability
If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force.
18. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Michelle Walstra regarding your use of Winnow and supersede any prior agreements on that subject.
